- Facilitating purchases or payments to third-party vendors

- Offering tools for tracking and managing spending
We are not a correctional facility, government agency, or vendor, and we do not control third-party providers.
2. Eligibility
You must:
- Be at least 18 years old
- Have the legal capacity to enter into a binding agreement
- Use the Services in compliance with applicable laws
By using our Services, you represent and warrant that you meet these requirements.
3. User Accounts
To access certain features, you may need to create an account.
You agree to:
- Provide accurate and complete information
- Maintain the security of your login credentials
- Be responsible for all activity under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Nature of the Platform
In-Kind Supply acts as a facilitator and intermediary, not a direct provider of goods or services.
All purchases, payments, or services fulfilled through third-party vendors are subject to those vendors' terms. We do not guarantee availability, pricing, delivery, or acceptance of any order by correctional facilities. Correctional institutions maintain ultimate authority over what is permitted.
5. Payments and Fees
By using our platform:
- You authorize us (or our payment processors) to charge your selected payment method
- Prices may include service fees, processing fees, or third-party markups
- All payments are final unless otherwise stated
We may change pricing at any time, with or without notice.
6. Refunds and Disputes
Because we work with third-party vendors and correctional systems:
- Refund eligibility depends on the policies of the underlying vendor
- We do not guarantee refunds for rejected, delayed, or confiscated items
- We may assist in dispute resolution but are not liable for outcomes
7. Acceptable Use
You agree not to:
- Use the Services for unlawful or fraudulent purposes
- Misrepresent identities or relationships
- Attempt to bypass correctional facility rules or restrictions
- Interfere with the operation or security of the platform
Violation of this section may result in immediate termination.
8. Data and Privacy
Your use of the Services is also governed by our Privacy Policy.
Important note:
- We collect information necessary to facilitate transactions (e.g., names, facility details, preferences)
- We do not store sensitive data of incarcerated individuals beyond what is required to complete transactions
- We implement reasonable safeguards but cannot guarantee absolute security
9. Intellectual Property
All content on the platform—including branding, design, text, and software—is owned by In-Kind Supply or its licensors.
You may not:
- Copy, reproduce, or distribute our content
- Reverse engineer or exploit the platform
10. Service Availability
We do not guarantee that:
- The platform will be uninterrupted or error-free
- All vendors or facilities will be supported at all times
- We may modify or discontinue features at any time
11. Disclaimers
The Services are provided "as is" and "as available."
We disclaim:
- All warranties, express or implied
- Responsibility for third-party vendor performance
- Liability for facility-level decisions (e.g., rejection of items, account restrictions)
12. Limitation of Liability
To the fullest extent permitted by law:
In-Kind Supply shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of funds due to vendor issues or facility restrictions
- Delays, rejections, or confiscations by correctional institutions
Our total liability shall not exceed the amount you paid through the platform in the past 3 months.
13. Indemnification
You agree to indemnify and hold harmless In-Kind Supply from any claims arising from:
- Your use of the Services
- Your violation of these Terms
- Your interactions with third-party vendors or institutions
14. Termination
We may suspend or terminate your access at any time if:
- You violate these Terms
- We are required to comply with legal or regulatory obligations
- You may stop using the Services at any time.
15. Governing Law
